{"id":252199,"date":"2014-04-15T20:49:42","date_gmt":"2014-04-15T16:49:42","guid":{"rendered":"http:\/\/www.epress.am\/?p=252199"},"modified":"2014-04-15T20:49:42","modified_gmt":"2014-04-15T16:49:42","slug":"appeal-dismissed-artists-could-be-fined-for-graffiti-of-imprisoned-political-activist","status":"publish","type":"post","link":"https:\/\/epress.am\/en\/2014\/04\/15\/appeal-dismissed-artists-could-be-fined-for-graffiti-of-imprisoned-political-activist.html","title":{"rendered":"Appeal Dismissed: Artists Could be Fined for Graffiti of Imprisoned Political Activist"},"content":{"rendered":"<p>\n\t<span style=\"line-height: 1.6em;\">The RA Administrative Court of Appeal dismissed the appeal of four members of Art Laboratoria, who were appealing a <a href=\"http:\/\/www.epress.am\/en\/2014\/02\/23\/court-rejects-art-activist-groups-lawsuit-against-armenian-police.html\"><span style=\"color:#0000CD;\"><strong>lower court&#39;s decision<\/strong><\/span><\/a> to reject the petition to reinstate a missed deadline to appeal and refuse to accept their claim.&nbsp;<\/span>\n<\/p>\n<p>\n\tAs told to Epress.am by Helsinki Association for Human Rights attorney Gayane Khachatryan, who is representing Art Laboratoria&#39;s interests, the claim was submitted two days late, after the prescribed two-month period, because the postal service belatedly delivered the return notice receipts that must be attached to the claim; otherwise, the court will return it.&nbsp;\n<\/p>\n<p>\n\tRecall, the artists are asking the court to annul RA Police Arabkir Division Chief Grisha Amirkhanyan&#39;s December 2013 decision to slap them with an <a href=\"http:\/\/www.epress.am\/en\/2013\/12\/03\/artist-activists-fined-300-for-graffiti-of-arrested-opposition-leader.html\"><span style=\"color:#0000CD;\"><strong>administrative fine of 30,000 AMD<\/strong><\/span><\/a> (about $75 USD) each for <a href=\"http:\/\/www.epress.am\/en\/2013\/11\/11\/police-detain-artists-for-4-hours-for-graffiti-portrait-of-shant-harutyunyan-video.html\"><span style=\"color:#0000CD;\"><strong>stencilling<\/strong><\/span><\/a> on the walls of Armenia&#39;s National Assembly on Nov. 10, 2013, the portrait of Shant Harutyunyan, a political activist detained during clashes with police in Yerevan on Nov. 5, 2013.\n<\/p>\n<p>\n\tKhachatryan said that earlier, the Administrative Court found that presenting these is not obligatory, since the RA Constitutional Court in its December 10, 2013 decision ruled that the legislative act in Article 73 of the RA Administrative Procedure Code (which is no longer in effect since January 7, 2014) contradicts Article 18 Section 1 of the RA Constitution and is invalid.
