{"id":281148,"date":"2017-06-14T16:50:04","date_gmt":"2017-06-14T12:50:04","guid":{"rendered":"http:\/\/epress.am\/?p=281148"},"modified":"2017-06-14T16:50:04","modified_gmt":"2017-06-14T12:50:04","slug":"yerevan-court-to-hear-appeal-against-1000-drams-law","status":"publish","type":"post","link":"https:\/\/epress.am\/en\/2017\/06\/14\/yerevan-court-to-hear-appeal-against-1000-drams-law.html","title":{"rendered":"Yerevan Court to Hear Appeal Against \u20181000 Drams Law\u2019"},"content":{"rendered":"<p>The Kentron and Nork Marash district court in Yerevan will on July 12 hear an appeal filed by the Helsinki Citizens\u2019 Assembly Vanadzor office (HCAV) seeking the return of the <strong><span style=\"color: #003366;\"><a href=\"http:\/\/epress.am\/en\/2016\/12\/15\/military-benefits-bill-passes-third-reading-in-armenian-parliament.html\">1000 drams<\/a><\/span><\/strong> that working Armenian citizens have been mandatorily contributing since January 1, 2017, to a fund financing military benefits program. According to the applicant, the recently adopted law \u00abOn Compensation of Damages Caused to the Life or Health of Servicemen During the Protection of Republic of Armenia\u00bb, which envisages the aforementioned payments, \u201cviolates property rights, is anti-constitutional, anti-legal and discriminatory.\u201d<\/p>\n<p>Speaking at a press conference on Wednesday, HCAV head Artur Sakunts dubbed the the law \u201can unreasonable means of enrichment.\u201d<\/p>\n<p>\u201cThese 1000 drams are a part of our property since, according the judicial precedents of the European Court of Human Rights&#8217; case law, a person\u2019s salary is his\/her property. This is the main norm, on which further substantiation of the claim is based,\u201d Sakunts said.<\/p>\n<p>The 10th article of the law, he went on, introduces the concept of a \u201cstamp fee,\u201d which contradicts the definitions of the terms \u201ctax\u201d and \u201cduty\u201d in the Constitution. A tax is an obligatory payment for ensuring the financial means of the public authority, and a duty is for territorial self-government. Meanwhile, the payer does not receive any services in return for the \u201cstamp fee\u201d introduced in the \u201c1000 Drams Law\u201d<\/p>\n<p>According to the applicants, the law is also discriminatory because it only envisages benefits for soldiers killed or wounded after January 1, 2017; meanwhile, the state has a positive obligation to all servicemen.<\/p>\n<p>HCAV intends to also file an appeal with the Constitutional Court, and if the appeal is not granted, they will go straight to the European Court of Human Rights.<\/p>\n<p>\u201cWe realize that the country has a shortage of financial means, but it cannot serve as an excuse for resolving the issue by anti-legal methods. We have an oligarchy, shadow funds &#8211; 500 million dollars.
