{"id":282602,"date":"2017-10-30T14:14:20","date_gmt":"2017-10-30T10:14:20","guid":{"rendered":"http:\/\/epress.am?p=282602"},"modified":"2017-10-30T14:14:20","modified_gmt":"2017-10-30T10:14:20","slug":"yerevan-court-denies-appeal-against-1000-drams-law","status":"publish","type":"post","link":"https:\/\/epress.am\/en\/2017\/10\/30\/yerevan-court-denies-appeal-against-1000-drams-law.html","title":{"rendered":"Yerevan Court Denies Appeal Against \u20181000 Drams Law\u2019"},"content":{"rendered":"<p>The Kentron and Nork Marash district court in Yerevan denied on Monday an appeal filed by the Helsinki Citizens\u2019 Assembly Vanadzor office (HCAV) against the \u201c<span style=\"color: #003366;\"><strong><a href=\"http:\/\/epress.am\/en\/2016\/12\/15\/military-benefits-bill-passes-third-reading-in-armenian-parliament.html\"><span style=\"color: #003366;\">1000 drams\u2019 law<\/span><\/a><\/strong><\/span>.\u201d Recall, working Armenian citizens have been mandatorily contributing a monthly thousand drams since January 1, 2017, to a fund financing a military benefits program. According to the applicant, the law \u00abOn Compensation of Damages Caused to the Life or Health of Servicemen During the Protection of Republic of Armenia\u00bb, which envisages the aforementioned payments, \u201cviolates property rights, is anti-constitutional, anti-legal and discriminatory.\u201d<\/p>\n<p>\u201cThese 1000 drams are a part of our property since, according the judicial precedents of the European Court of Human Rights\u2019 case law, a person\u2019s salary is his\/her property. This is the main norm, on which further substantiation of the claim is based,\u201d Arthur Sakunts, head of the HCAV, <span style=\"color: #003366;\"><strong><a href=\"http:\/\/epress.am\/en\/2017\/06\/14\/yerevan-court-to-hear-appeal-against-1000-drams-law.html\"><span style=\"color: #003366;\">had said<\/span><\/a><\/strong><\/span> at a press conference back in June.<\/p>\n<p>The 10th article of the law, according to Skaunts, introduces the concept of a \u201cstamp fee,\u201d which contradicts the definitions of the terms \u201ctax\u201d and \u201cduty\u201d in the Constitution. A tax is an obligatory payment for ensuring the financial means of the public authority, and a duty is for territorial self-government.
