Human Rights Defender of Armenia Karen Andreasyan has submitted three (3) reports to the RA Council of Justice on being subject to disciplinary action, since according to him, judges Yerem Yesoyan, Masis Rehanyan, and Yurik Iskoyan ventured obvious and gross violations of the law during the last year, according to a statement issued by the RA Human Rights Defender’s Office.
It took Judge Yerem Yesoyan a period of nineteen (19) months to consider the dispute between mother and son regarding just 9.6 square meters of residential space; that is, he didn’t meet the requirement of the law to examine the case within a reasonable time. In addition, Judge Yesoyan ignored the requirement to terminate the right of using a residential space, clearly defined by the law, which resulted in a gross violation of the citizen’s right.
Judge Masis Rehanyann ignored a citizen’s lawful plea to submit the arguments examined by the RA Court of First Instance to the RA Court of Appeal for re-examination on the grounds that no motion of that kind had been made.
Judge Yurik Iskoyan made the citizen’s guilt a subject of discussion while ruling on the case of arresting him, which is an obvious and gross infraction of the presumption of innocence of an individual. Moreover, the judge did not provide an interpreter for the defendant. In addition, at the beginning, the date of the arrest wasn’t mentioned in the court decision; afterwards, in violation of the law, a decision was made to correct the inaccuracy and, ultimately, the arrest date was set; however, here too the law was violated as the issue was resolved without the defendant’s participation.
A number of negative evaluations on impartiality and effectiveness of the RA Council of Justice have been already expressed, though the Defender is expecting that the Council will make fair decisions based on his reports.
