I am prepared to go through all levels of the judicial system in Armenia to get a fair ruling in the case of the Pak Shuka ("covered market"), Heritage Party MP Zaruhi Postanjyan said today after a session at the Court of General Jurisdiction of Kentron and Nork-Marash Administrative Districts.
Note, Postanjyan earlier had appealed to the police, asking to consider the destruction of the building belonging to Republican Party of Armenia MP, oligarch Samvel Aleksanyan as destruction of a historical monument. Yerevan City Hall did not intervene and stop demolition of the monument, which is also unacceptable, added the MP.
"The Pak Shuka developer and Yerevan mayor Taron Margaryan allowed the violation of Article 264 [of the RA Criminal Code], the destruction or damage to historical and cultural monuments, as well as violation of Article 315.1, not stopping the construction of an unauthorized building and not demolishing an illegal structure, and Article 315.2, failure to stop the unauthorized construction of a building and take preventative action as prescribed by law," said Postanjyan's appeal, in part.
The RA Police rejected Postanjyan's complaint and didn't open a criminal case because of the absence of corpus delicti. Subsequently, the MP appealed to the Prosecutor General, but again it failed to lead to results, and so, she took the matter to court, asking the court to cancel the refusal to open a criminal case.
In the court presided over by Judge Gagik Poghosyan, Postanjyan's representative Hermine Mikaelyan motioned to get two days to become acquainted with the grounds of the prosecutor's refusal to launch criminal proceedings. Mikaelyan suggested it might be necessary to amend the complaint. The court sustained the motion.
After the session, Postanjyan again said that Samvel Aleksanyan's actions are clearly illegal and were not supervised by Yerevan City Hall, which is also a violation of the law.
