Construction work that was halted due to a Nov. 2 court decision resumed early this morning at 5 Komitas Ave., one of the residents of 5a Komitas Ave., Nelly Voskanyan, informed Epress.am.
Earlier, the resident protesting the construction said the court considered justified the request by residents of 3, 5a and 7 Komitas Ave. and decided to prohibit Liber LLC from further construction work until the court ruling is in effect.
Residents also asked that construction be halted until the court rules on its lawfulness. The final decision will be made end of November. Meanwhile, the owner of the land, Edgar Keshishyan, has launched a counter lawsuit against the residents, who believe their demands have been partly met. The court sustained Keshishyan's lawsuit, requiring residents to compensate him $40,600 of the $360,000 loan he received from the bank to construct the building, which "he lost because of them."
At the court hearing on Nov. 15, residents motioned to postpone the hearing because their attorney, Anushavan Nikoghosyan, could not be present, but the court rejected the petition.
"Liber LLC's attorney made a motion stating that the residents are obliged to compensate the construction company for damages. The attorney represented Yerevan City Hall also considered the demand legitimate. Judge Ruzanna Hakobyan, without taking us into consideration, sustained the motion and obliged to pay the amount in 3 days, adding that otherwise the ban on construction will be lifted," said Voskanyan, who is convinced that all this was originally planned and they will now develop another plan of action.
"We, the residents of Komitas 5, Sayat-Nova 10 and 12, and Amiryan have united and we will take the case to a desirable outcome," she concluded.
