After suffering from 10 months of beating and torture from her mother-in-law and husband, Mariam Gevorgyan, is demanding moral and financial compensation for her inflicted grief and injuries. Epress.am was informed about the demands from Gevorgyan’s lawyer, Tigran Muradyan.
The case for compensation against the mother-in-law and husband was decided much earlier and is examined at the Ararat and Vayots Dzor General Jurisdiction Court, proceeded by Yelena Kocharyan.
The Gevorgyan side is discontent with the conducted medical examinations which, according to the plaintiffs, not only gave very biased responses but also completely left out important issues. Thus, in accordance to expert opinion it is not possible to reestablish Mariam Gevorgyan’s injuries. “We have applied to many medical institutions and they expressed that Mariam Gevorgyan’s injuries can be reestablished,” said Muradyan, Gevorgyan’s lawyer.
According to the lawyer, the court has given the opportunity to prove the possibility of reestablishing the injuries, which to Muradyan, is the first step. Subsequently, the price for reestablishing the physical injuries needs to be measured, in order to be compiled in the compensation sum.
Pertaining to moral damage, the lawyer said that that system does not work in Armenia. “The Constitutional Court has made a decision, that the absence of moral damages from legislation is unconstitutional,” said Muradyan.
Recall, that Gevorgyan’s mother-in-law, Haykanush Mikayelyan, was sentenced to 4 years imprisonment, however, she was released during 1/3rd of her sentence due to amnesty. This judicial act left the Court of Appeals unchanged.
